This Terms of Use Agreement (“Agreement”) is a legally binding agreement between Bitmap Studio (“Bitmap”) and the client (“Client”), governing the use of https://www.bitmapstudio.co and all related services. By accessing or using Bitmap’s services, the Client agrees to these Terms. If the Client does not agree, use of the Website and services must be discontinued.


1. Services & Subscription Model

Bitmap provides design and production services through a subscription model based on active service days, not fixed calendar usage.

Each plan includes:

  • Monthly: 31 active service days

  • Multi-month plans: combined total (e.g. 93 days for 3 months)

A service day is defined as a day during which Bitmap actively works on Client requests.

Service days are only deducted when work is in progress.


2. Pausing & Usage of Time

Clients may pause their subscription at any time.

While paused:

  • no service days are consumed

  • all remaining days are preserved

At the end of the billing cycle (or full subscription term for multi-month plans):

  • any unused service days are automatically carried forward

  • and applied immediately as a continuous extension

Unused service days:

  • must be used immediately after the billing period

  • cannot be stored or deferred

  • cannot be transferred to future subscriptions

This ensures all purchased time is fully usable.


3. Multi-Month Plans

For multi-month subscriptions:

  • all service days are combined into a single pool

  • usage is flexible within the term

  • any unused days are applied after the term ends

Example:
A 3-month plan includes 93 days. If 40 days are used, the remaining 53 days are applied immediately after the term.

Once all service days are used, the subscription ends unless renewed.


4. Renewals

If the subscription is renewed:

  • any remaining carried-forward days must be used first

  • the new subscription begins only after those days are exhausted

Service time does not accumulate across multiple subscription periods.


5. Workflow & Delivery

All work is managed through Bitmap’s designated platform.

  • Starter plan: 1 active request at a time

  • Premium plan: multiple active requests

Work is completed in a queue system.

Bitmap reserves the right to:

  • manage task prioritization

  • define reasonable scope per request

  • schedule work based on capacity


6. Turnaround Times

Estimated turnaround times:

  • Standard: 2–3 business days

  • Priority: 1–2 business days

These are estimates only.

Delivery may vary depending on:

  • complexity

  • clarity of request

  • speed of feedback

Bitmap is not responsible for delays caused by the Client.


7. Refund Policy

Bitmap offers a 75% refund within the first 7 days of the initial subscription.

After this period:

  • all payments are non-refundable

  • due to allocation of resources

If a refund is granted:

  • all work remains the property of Bitmap

  • the Client may not use any delivered materials

Processing fees are non-refundable.


8. Ownership of Work

Upon full payment:

  • all final deliverables are owned by the Client

Bitmap retains the right to:

  • display work in its portfolio

  • unless restricted by a written NDA


9. Third-Party Assets

If a project includes third-party assets (fonts, stock, music, etc.):

  • Bitmap will inform the Client

  • the Client is responsible for obtaining licenses

Bitmap is not liable for improper use of unlicensed assets.


10. Client Responsibilities

The Client agrees to:

  • provide clear instructions and feedback

  • supply legally owned materials

  • respond within reasonable timeframes

Delays from the Client may impact delivery timelines.


11. Intellectual Property (Website)

All Website content, including code, visuals, and branding, is owned by Bitmap and protected by applicable intellectual property laws.

No content may be reused or reproduced without written permission.


12. Prohibited Use

The Client agrees not to:

  • misuse the Website

  • attempt to reverse engineer systems

  • interfere with operations

  • use the service for unlawful purposes


13. Disclaimer

All services are provided “as-is” and “as available.”

Bitmap makes no guarantees regarding:

  • uninterrupted service

  • error-free delivery


14. Limitation of Liability

Bitmap is not liable for:

  • indirect or consequential damages

  • loss of revenue, data, or business opportunities


15. Indemnification

The Client agrees to indemnify and hold Bitmap harmless from any claims resulting from:

  • misuse of services

  • violation of these Terms

  • infringement of third-party rights


16. Privacy

Use of the Website is subject to Bitmap’s Privacy Policy.

By using the service, the Client agrees to the collection and use of data as outlined.


17. Modifications

Bitmap may update these Terms at any time.

Continued use of the service constitutes acceptance of updated Terms.


18. Governing Law

These Terms are governed by the laws of Thailand.

All disputes shall be resolved in Thai courts.


19. Miscellaneous

These Terms constitute the full agreement between Bitmap and the Client.

If any provision is invalid, the remaining provisions remain in effect.
